2003 Column No. 13 - NCAA Division I Proposal No. 2001-76 (as amended by
2001-76-1) - Recruiting Materials - Camp Brochures
Date Issued: Jun 23, 2003
Type: LA Col.
Interpretation:
NCAA Division I institutions should note that with the adoption of NCAA Proposal
No. 2001-76 (as amended by 2001-76-1), effective August 1, 2003, pursuant to
NCAA Bylaw 13.4.1-(c), camp brochures are no longer restricted in content or
design, but are restricted to a single, two-sided sheet not to exceed 17" x 22"
when opened in full. However, Proposal No. 2001-76 (as amended by 2001-76-1) did
not affect the application of Bylaw 12.5.1.7 (summer camps). Pursuant to Bylaw
12.5.1.7, a currently enrolled student-athlete’s name, picture and institutional
affiliation may appear in institutional or privately owned summer camp brochures
only in the camp counselor section to identify the student-athlete as a staff
member. A student-athlete’s name or picture may not be used in any other way to
promote the camp. Therefore, while camp brochures will no longer be restricted
by general content or design, the use of a student-athlete’s name and picture is
still restricted to the camp counselor section of an institution’s brochure in
order to identify the student-athlete as a staff member.
2002 Column No. 20 -- NCAA Division I Bylaw 12.5.1.7 -- Summer Camps and
Division I Bylaw 13.4.1 Recruiting Materials
Date Issued: Sep 30, 2002
Type: LA Col.
Item Ref: 2002 Column No. 20
Interpretation:
Please note that an institutional or privately owned summer camp may use a
student-athlete’s name, picture and institutional affiliation only in the camp
counselor section in its summer-camp brochure to identify the student-athlete as
a staff member. A student-athlete’s name or picture may not be used in any other
way to directly advertise or promote the camp. During its March 24, 1998,
teleconference, the NCAA Division I Academics/Eligibility/Compliance Cabinet
Subcommittee on Legislative Review/Interpretations (LRIS) determined that an
institution's camp brochure may include quotations from former campers, parents
of former campers and prospective student-athletes' coaches related to the camp.
Further, institutions should note that in accordance with Division I Bylaw
13.4.1-(c), information contained in camp brochures must relate specifically to
camp events and activities and may not contain information that may not be
provided to prospective student-athletes. Therefore, any pictures and
information included in the camp brochure must relate to the camp. In that
regard, it would not be permissible for institutions to include pictures of
former student-athletes in its camp brochures unless the pictures relate
specifically to camp events and activities.
Application of Restrictions:
* Pictures of institutional facilities filled with spectators (e.g., stadiums,
arenas) are permitted in the brochure, provided the facility will be utilized
during the camp.
* Pictures of student-athletes may appear only in the camp counselor section of
the camp brochure.
* Institutions are permitted to use action photos of student-athletes in the
camp counselor section, provided the photo does not include other
student-athletes with eligibility remaining that will not be working the camp.
* If a former student-athlete will work the camp, the former student-athlete’s
picture should appear in the camp counselor section.
* If a former student-athlete will not work at the camp, the institution should
not use the picture unless there is a direct connection between the former
student-athlete and the camp (e.g., former counselor, former camper).
